Important legal and regulatory information about our products and services

Not all of our products and services are available from all the jurisdictions in which we operate. Banking and investment services are made available through Citi licensed branches in London and Jersey and the investment and banking services offered are limited to those which the relevant Citi branch has appropriate regulatory approvals to offer. Please note that Jersey and London have different legal, tax and regulatory rules (including different rules on investor protection). Clients considering these centres should seek independent advice as to which centre would be appropriate for their particular circumstances.

Deposits and investments

Citibank N.A., Jersey Branch is a member of the Depositors Compensation Scheme as set out in the Banking (Depositors Compensation)(Jersey) Regulations 2009.

The UK Financial Services Compensation Scheme (the "Scheme") provides compensation in certain instances where Citibank N.A., London Branch or Citibank International Plc is unable, or likely to be unable, to satisfy protected claims against it. In such circumstances, the Scheme may provide compensation for claims relating to various services provided by Citibank N.A., London Branch or Citibank International Plc such as deposit-taking and investment business. However, the Scheme is governed by specific rules on compensation which determine your eligibility, the circumstances in which compensation will be available to you, and the limits on compensation payable to you. Any recovery under the Scheme is therefore subject to your specific circumstances, the nature of your claim and the specific rules of the Scheme.

Claims under the Scheme in relation to deposits and investment business are subject to maximum limits on compensation, as published from time to time on the FSCS website. It is not possible to claim an amount in excess of the published limit even where the financial loss suffered or the amount of initial deposit or investment is higher. The current compensation limit for deposits as at January 2009 is set at 100% of the first £50,000 per client per authorised firm. The current limit for investment business as at January 2009 is set at £48,000 per client per authorised firm (100% of the first £30,000 and 90% of the next £20,000). Up-to-date information on the limits applicable under the Scheme is available at: www.fscs.org.uk.

Security

Your security is very important to us

We have gone to extraordinary lengths to ensure that your transactions with Citibank Online are completely secure, so that your account is safe. Our security features use the very latest technology and processes.

Citi currently offers 3 levels of security to help safeguard your financial information - these are described below:

Strong encryption (128-bit)

All data sent to and from Citi is 'scrambled' and 'resembled' between Citi and your personal computer to protect your personal and financial information. Your PIN does not travel on the Internet during login authentication, and the session is Triple DES encrypted. Hence nobody can intercept your PIN while you are using Citibank Online.

Password

Your password must be entered every time you sign on to Citibank Online. Remember, always keep your password and PIN confidential.

Automatic time out

There is a security feature intentionally built-in to the system. When there is no activity for reasonable time, Citi will terminate your secure Citibank Online session to help protect against unauthorised access.

Additionally, Citi also ensures security of your banking account and ATM/debit card by using a Fraud Early Warning System (FEWS). We use our worldwide experience and technology to provide you the safest services.

Some simple steps you can take to ensure your security – we recommend you print these tips and keep them handy.

3 key tips to remember:

1.
If you suspect a website is not what it purports to be, leave the site. Do not follow any of the instructions it may present you.
2.
If you believe that someone is trying to commit fraud by pretending to be Citi, please contact us immediately. We never ask your personal information, card number and PINs through e-mail.
3.
Ask yourself if the information you are asked to provide makes sense for the activity you are engaged in. For example, an online auction site should not ask for your driver's license number or the PIN for your debit card. If a site or e-mail asks for information that doesn't feel right, do not respond.

Additional security tips:

  • Be alert for scam e-mails. These may appear to come from a trusted business or friend, but actually are designed to trick you into downloading a virus or jumping to a fraudulent website and disclosing sensitive information.
  • Do not reply to any e-mail that requests your personal information. Be very suspicious of any business or person who asks for your password, social security number or other highly sensitive information. Citi will never ask for any information of this nature in an e-mail. Please read our information on fraudulent emails.
  • Open e-mails only when you know the sender. Be especially careful about opening an e-mail with an attachment. Even a friend may accidentally send an e-mail with a virus.
  • Be careful before you click on a link that is contained in an e-mail or other message. The link may not be trustworthy.
  • Do not send sensitive personal or financial information unless it is encrypted on a secure website. Regular e-mails are not encrypted.
  • Do business only with companies you know and trust.
  • Be aware! Fake "look alike" websites are designed to trick consumers and collect their personal information. Make sure that websites on which you transact business post privacy and security statements and review them carefully.
  • Verify the address of every website, known as the URL.
  • Make sure that the URL you want appears in the "address" or "location" box on your browser window. Some websites may appear to be legitimate but actually are counterfeits. Take a few extra seconds and type the URL yourself.
  • Look for the padlock symbol at the bottom right of a web page to ensure the site is running in secure mode BEFORE you input sensitive information.
  • Use strong passwords or Pins for your Internet accounts. Choose passwords that are difficult for others to guess, and use a different password for each of your accounts. Use both letters and numbers and a combination of lower case and capital letters if the passwords or Pins are case sensitive.
  • Ensure that you change your password regularly. At least once a month.
  • For maximum security, we would advise you to memorise your PIN and keep it secret. Please do not write the PIN on your Citicorp or Citi credit card or reveal it to anyone.
  • Log off. Do not just close your browser. Follow the secure area exit instructions to ensure your protection.
  • Monitor your transactions. Review your order confirmations, credit card, and bank statements as soon as you receive them to make sure that you are being charged only for transactions you made. Immediately report any irregularities.
  • Make sure your home computer has the most current anti-virus software. Anti-virus software needs frequent updates to guard against new viruses. Make sure you download the anti-virus updates as soon as you are notified that a download is available.
  • Avoid conducting any banking transactions in an area where Internet service is available to the public e.g. cyber cafes. It is very difficult to ensure these PCs are free of any hacking programs which can capture your personal / account information. Should you have to perform transactions on public PCs, please change your PIN from your computer after you have used a public computer. This is important because there could be a risk of capturing your keystrokes (including your card number and PIN) by certain programs running in the memory of the shared PC without your knowledge.

Internet banking terms and conditions

Terms and Conditions

1.1. Please read these terms and conditions carefully as they explain Your rights and responsibilities and those of Citi International Personal Bank in respect of Your use of Citi's Internet Banking Service ("the Service"). These Terms and Conditions incorporate the General Terms and Conditions of the Citi centre where You hold Your account and the Citi Website terms and conditions of use. If there are any differences between them, these Terms and Conditions override those other terms and conditions to the extent applicable. You understand that by using any aspect of the Service You agree to be bound by these terms and conditions.

1.2. In these terms and conditions "You", "Your" and "Yours" are references to the person requesting the Service and "We" "Us" and "Our" are references to the Citi centre where Your account is held.

1.3. The Service will allow You to give Us electronic instructions by using Your PC and your chosen username, password, confirmation question answer and challenge question answers. The instructions that can be given in this way are set out in "Tell Me More About Internet Banking" (the Guide), which also forms part of these Terms and Conditions.

1.4. You can use the Service 24 hours a day and We will endeavour to carry out Your instructions promptly. If you ask us to carry out a transaction after 5pm (or on a day We are not usually open) the transaction will not go ahead until the next business day (this is Monday to Friday excluding bank holidays).

1.5. You must not use the Service to give any instructions on an Account unless You have sufficient funds in that Account.

1.6. If You want to use the Service, You must have (a) a Citi International Personal Bank Debit or ATM card and PIN (b) a PC (c) access to the Internet (d) a browser that supports 128 bit encryption and (e) a modem. You are responsible for providing the PC and modem and connecting the PC to the public telephone service. You will be responsible for the costs of using the telephone service and/or the charges made by any Internet Service Provider. We make no promises or provide any warranties with respect to either the speed or the resolution, or access to the Service.

1.7. The Service can only be accessed through browsers with 128 bit encryption capabilities. The use of such levels of encryption may be considered illegal in some jurisdictions. It is Your responsibility to ensure that Your ability to use the Service is permitted by the law applicable to where you use the Service. We shall not be liable for any loss or damage suffered by You as a result of not being able to use the Service in these jurisdictions.

1.8. We reserve the right to charge a monthly service charge for using the Service. If we exercise this right, we will give at least 30 days notice before We do so.

Your Password

2.1. You must take precautions to prevent the disclosure and unauthorised use of Your password. For example:

2.1.1. Never write or otherwise record Your password in a way that can be understood by someone else;

2.1.2. Avoid passwords which may be easy to guess such as birthdays and telephone numbers;

2.1.3. Never record Your password on any software which retains it automatically, for example any 'save password' feature on Your Internet browser.

2.2. Once You have logged on to the Service, You must not at any time leave the Service or let anyone else use the Internet terminal until You have logged off the Service. You will be responsible for ensuring that You have logged off the Service at the end of each session.

2.3. You must not access the Service from any computer connected to a local area network (LAN) or any public internet access device or access point without making sure that no one else will be able to observe or copy Your access or get access to the Service pretending to be You.

2.4. You must tell us immediately of any unauthorised access to the Service or any unauthorised transaction or instruction which You know of or suspect, or if You suspect that someone knows Your password. You can do this by contacting your Relationship Manager or by calling +44 (0) 20 7986 5888. We would expect You to co-operate with Us and with the police in any investigation. We may also disclose information about You or Your account to the police or other third parties if We think it will help prevent or recover losses.

2.5. You agree to check carefully Your records of transactions and statements of accounts and inform us immediately of any discrepancy.

Carrying out Your Instructions

3.1. You instruct us to comply with any instructions given to Us through use of the Service. If We are given those instructions by means of a PC and Your username and password We shall be entitled to assume that those instructions are given by You.

3.2. We may refuse to act on an instruction, for example if We know or suspect a breach of security or if We deem that the instruction is not accurate and complete.

3.3. We may suspend the Service or any part of it without notice where We consider it necessary to do so, for example where there is a suspected breach of security or to carry out maintenance to the Service. We will inform You through the Service or website if the Service or any part of it becomes unavailable.

3.4. We will make all reasonable efforts to modify, not process or delay processing any instruction where You request Us not to do so, but We shall not be liable for any failure to comply with such a request.

3.5. You must make sure that any instruction is accurate and complete and We are not liable if this is not the case.

3.6. A transaction being carried out is not always simultaneous with an instruction being given. Some transactions may take time to process and may only be processed during normal banking hours even though the Service may be accessible outside such hours.

3.7. You accept that for any instruction You send relating to mutual funds or other investment products, it is Your responsibility to ensure that the instruction complies with the product terms agreed by You and that any instruction is subject to all such product terms.

3.8. For the purposes of these terms and conditions product terms means any documentation, including, without limitation, terms and conditions, Key Features Documents, prospectuses or scheme particulars governing the investment product. In the event of any conflict between these terms and conditions and any product terms, these terms and conditions shall prevail in respect of instructions relating to investment products unless expressly provided otherwise.

Unauthorised transactions

4.1. We will refund You the amount of any transaction carried out in accordance with Your instructions where Your password has been used without Your authority, unless 4.2 below applies.

4.2. Your liability will be unlimited for any loss from use of Your password by any person who acquired possession of it with Your consent, or if You have acted fraudulently or with gross negligence. For example You may be deemed to have acted with gross negligence if You fail to follow the safeguards set out in 2.1 above.

'Tell Me More About Internet Banking' (the 'Guide')

5.1. The Guide is available on-line and it and any updates to it are part of this agreement. We recommend that you read the Guide and familiarise Yourself with its contents before first using the Service. You must comply with the procedures set out in the Guide that We give You. We can reasonably vary or replace the Guide. You understand that entering Your password as described in the Guide shall be sufficient confirmation of the authenticity of any instructions given on that occasion.

Force Majeure

6.1. We agree to make reasonable efforts to ensure full performance of the Service. We will not be liable for any failure to provide the Service or to comply with these Terms and Conditions for any cause that is beyond Our reasonable control. We will not be liable for any losses or delays in the transmission of instructions caused by any Internet Service Provider or by software failure or for any indirect or consequential loss You suffer as a result of this Service.

Your Information

7.1. We may pass information to other Citigroup organisations and third party organisations where it is reasonably necessary to do so for processing Your instructions with Us or them or to enable them to provide other services to You. To do this, We may have to transfer Your information to countries outside the European Economic Area (EEA) including the USA. You understand that countries outside the EEA may not provide the same levels of data protection as countries inside the EEA. However, all data is held in accordance with our Privacy Policy, which is available for You to read on Our website.

7.2. You understand that We, or any third party to whom We have transmitted information about Your information, will be required to disclose this information if legally compelled to do so.

Miscellaneous

8.1. We may for any valid reason alter, suspend or terminate (a) the Service or (b) Your right to use the Service without giving You notice beforehand, if We do so We shall inform You promptly. We shall not be liable to You for doing this.

8.2. We may for any valid reason vary these Terms and Conditions. We will send You details about changes either by e-mail, or in writing, or by advertisement, or by secure message, or notice within Online Banking. We will normally give you reasonable notice before any changes take effect unless it is not practical to do so, in which case we will tell you as soon as we can after the changes have taken place.

8.3. All notices and advices to be given by us to You under the Service may be given electronically or in writing to You at the mailing address We have in Our records. Where more than one of You are named as Account Holders, notice to one of You will be sufficient notice to all of You. All such notices and advices will be deemed to be received by You in the case of posting 5 days from dispatch to the last address provided by You, and in the case of notification by the Service 5 days from the posting of the notice or advice on the Service.
